Agreement between you and E-Pairokar

These Terms & Conditions constitute a legally binding agreement between you ("User", "Client", "Litigant") and Artify Minds Lab Pvt. Ltd. ("E-Pairokar", "we", "us", "our").

Introduction

Welcome to E-Pairokar, a legal-tech platform owned and operated by Artify Minds Lab Pvt. Ltd. (CIN: U85500UP2024PTC213004), registered at C-46, RDC, Rajnagar, Ghaziabad, Uttar Pradesh, India.

These Terms & Conditions govern your access to and use of the E-Pairokar website, mobile applications, and all associated services (collectively, the "Platform"). By using the Platform, you accept and agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific services.

If you do not agree to these Terms, please do not use the Platform or our services.

Definitions

For the purposes of these Terms, the following definitions apply:

  • "E-Pairokar" refers to the legal-tech platform and brand owned by Artify Minds Lab Pvt. Ltd.
  • "User" refers to any individual or entity accessing or using the Platform, including litigants, advocates, and visitors.
  • "Litigant" refers to a user who seeks legal coordination services through the Platform.
  • "Advocate" refers to a legal professional empanelled with E-Pairokar or engaged through our partner CLAPJURIS.
  • "Pairokar" refers to a relationship manager at E-Pairokar who coordinates between litigants and advocates.
  • "Services" refers to all legal coordination, case tracking, advocacy matching, and related services offered through the Platform.
  • "Proposal" refers to the service proposal sent to a litigant outlining scope, fees, and payment schedule.
  • "Customer ID" refers to the unique identifier assigned to each litigant for case tracking purposes.

Services Offered

E-Pairokar provides legal coordination and support services, including but not limited to:

  • Coordination between litigants and their existing advocates, including briefing, chasing updates, and maintaining communication.
  • Engagement of empanelled advocates through our legal execution partner, CLAPJURIS, for matters including bail, criminal trials, appeals, writ petitions, and other criminal-law matters.
  • Case tracking and status updates through the Platform's Track Case module.
  • Document review, analysis, and preparation of service proposals.
  • Facilitation of expert conferences and strategy meetings.
  • Transparent fee disclosure and payment scheduling.

The specific scope of services for each matter shall be detailed in the Service Proposal sent to the litigant.

User Obligations

By using the Platform, you agree to:

  • Provide accurate, complete, and current information when submitting a case or using the Platform.
  • Promptly update any changes to your information, including contact details and case developments.
  • Cooperate fully with your assigned Pairokar and provide all requested documents and information in a timely manner.
  • Make payments as per the Service Proposal and payment schedule.
  • Use the Platform only for lawful purposes and in compliance with all applicable laws and regulations.
  • Not impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Not interfere with or disrupt the Platform's functioning or security.
  • Not share your Customer ID or login credentials with any third party.

Payment Terms

All fees and payment schedules shall be clearly set out in the Service Proposal provided to the litigant.

  • Fee Transparency: E-Pairokar commits to full fee transparency. All applicable fees, charges, and payment schedules are disclosed in the Service Proposal before any engagement begins.
  • Payment Schedule: Payments are typically structured as an initial payment to commence services, followed by milestone-based payments as per the Service Proposal.
  • Payment Methods: Payments may be made through bank transfer, online payment gateways, or other methods specified in the Service Proposal.
  • Refund Policy: Refunds shall be governed by the terms set out in the Service Proposal. No refunds shall be issued for services already rendered or work already performed.
  • Taxes: All fees are exclusive of applicable taxes, which shall be borne by the litigant.

Limitation of Liability

To the maximum extent permitted by law:

  • E-Pairokar acts as a coordinator and intermediary between litigants and advocates. We do not provide legal advice directly and are not a law firm.
  • E-Pairokar takes complete responsibility for negligence on the part of any advocate it engages on a litigant's behalf, subject to the terms of the Service Proposal.
  • E-Pairokar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of the Platform or Services.
  • E-Pairokar's total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total fees paid by the litigant to E-Pairokar in the six months preceding the claim.
  • E-Pairokar does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
  • E-Pairokar shall not be liable for any delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, or governmental actions.

Dispute Resolution

Any dispute arising out of or relating to these Terms, the Platform, or the Services shall be resolved as follows:

  • Amicable Resolution: The parties shall first attempt to resolve the dispute amicably through mutual discussions within 15 days of the dispute arising.
  • Mediation: If amicable resolution fails, the parties shall attempt to resolve the dispute through mediation with a mutually agreed mediator.
  • Arbitration: If mediation fails, the dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Ghaziabad, Uttar Pradesh, in the English language, by a sole arbitrator appointed by mutual consent.
  • Jurisdiction: The courts at Ghaziabad, Uttar Pradesh, shall have exclusive jurisdiction over any matters arising out of or relating to these Terms.

Governing Law

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

The parties agree that the courts at Ghaziabad, Uttar Pradesh, shall have exclusive jurisdiction over any matters arising out of or relating to these Terms.

Amendments

E-Pairokar reserves the right to modify or update these Terms at any time, with or without prior notice. Any changes will be effective immediately upon posting on the Platform.

It is your responsibility to review these Terms periodically for any changes. Your continued use of the Platform after the posting of changes constitutes your acceptance of the modified Terms.

The date of the last update is displayed at the top of these Terms. If you do not agree to any changes, you must stop using the Platform and our Services.

Acceptance of Terms

If you are using the Platform on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.
